	The vast majority devices made by domestic dental laboratories do not meet the IRS&amp;rsquo;s Final Rule definition of a &amp;ldquo;Taxable Medical Device&amp;rdquo; as defined in &amp;sect; 48.4191&amp;ndash;2. &amp;ndash; December 7, 2012&lt;/div&gt;
&lt;div&gt;
	&lt;br /&gt;
	&lt;strong&gt;Taxable Medical Device &amp;ndash; IRS Final Rule&lt;/strong&gt;&lt;/div&gt;
&lt;div&gt;
	&lt;br /&gt;
	The IRS released its Final Rule on the Medical Device Tax on December 5, 2012. There was no change to the IRS proposed rule definition of &amp;ldquo;Taxable Medical Device&amp;rdquo; in the Final Rule. Therefore, the NADL&amp;rsquo;s analysis released in mid-October 2012 is confirmed. This is good news for most domestic dental laboratories as most domestic dental laboratories are manufacturing dental devices that are not required to be listed with the FDA. Devices that are not required to be listed as a device with the FDA do not meet the IRS definition of a &amp;ldquo;taxable medical device&amp;rdquo; and consequently will not be subject to the Medical Device Tax.&lt;/div&gt;

	&lt;strong&gt;&amp;sect; 48.4191&amp;ndash;2 Taxable medical device.&lt;/strong&gt;&lt;/div&gt;

	&lt;br /&gt;
	(a) Taxable medical device&amp;mdash;(1) In general. A taxable medical device is any device, as defined in section 201(h) of the Federal Food, Drug, and Cosmetic Act (FFDCA), that is intended for humans. For purposes of this section, a device defined in section 201(h) of the FFDCA that is intended for humans means a device that is listed as a device with the Food and Drug Administration (FDA) under section 510(j) of the FFDCA and 21 CFR part 807, pursuant to FDA requirements. (emphasis added)&lt;/div&gt;

	&lt;strong&gt;Discussion&lt;/strong&gt;&lt;/div&gt;
&lt;div&gt;
	&lt;br /&gt;
	Dental Laboratories make crowns, bridges, dentures, dental implants, mouth guards and orthodontic devices such as retainers and sleep apnea devices and snore guards. Many of the raw materials and components used to make these items (such as alloys, ceramic, resins, abutments, individual denture teeth, etc.) and some equipment such as articulators, handpieces and brushes are required to be listed with the FDA as a device. However, with the exception of sleep apnea devices and snore guards, most of the devices that are domestically made by dental laboratories are not required to be listed with the FDA.&lt;/div&gt;
&lt;div&gt;
	&lt;br /&gt;
	While the FDA requires all establishments that manufacture medical devices to register with the FDA and requires these establishments to list the devices that they manufacture with the FDA pursuant to 21 CFR 807, &amp;sect; 807.65(i) generally exempts domestic dental laboratories from the FDA&amp;rsquo;s device listing requirements. However, if a dental laboratory undertakes certain activities, such as importing devices or manufacturing sleep apnea devices or snore guards, the dental laboratory will be required to register with the FDA and list those devices it makes with the FDA. The FDA also requires crowns, bridges, dentures, dental implants, mouth guards and orthodontic devices to be listed if they are made by a foreign manufacturer and imported by a domestic dental laboratory.&lt;/div&gt;
&lt;div&gt;
	&lt;br /&gt;
	It is important to note that the IRS definition of importer that applies to excise taxes is different from the FDA&amp;rsquo;s importer definition. Under the IRS definition of &amp;ldquo;importer&amp;rdquo; the person who brings an article into the United States is only a nominal importer if they are not also the beneficial owner of the article. Generally, the cases and rulings hold that the &amp;ldquo;importer&amp;rdquo; is the first purchaser resident in the United States who arranges (as principal and not as an agent) for, or is the inducing and efficient cause of, goods being brought into the United States for sale or use by him. For example, if you engage a customs broker they are a nominal importer and the IRS deems the beneficial owner to be the importer for excise tax purposes, meaning the beneficial owner is the entity that will file quarterly returns and remit the tax to the IRS. See 26 CFR 48.0-2(a)(4) for the IRS definition of &amp;ldquo;importer.&amp;rdquo;&lt;/div&gt;

	&lt;strong&gt;Conclusion&lt;/strong&gt;&lt;/div&gt;

	&lt;br /&gt;
	Domestically made crowns, bridges, dentures, dental implants, mouth guards and orthodontic devices such as retainers are generally not required to be listed as a device with the FDA under section 510(j) of the FFDCA and 21 CFR part 807, pursuant to FDA requirements. Therefore, domestically made crowns, bridges, dentures, dental implants, mouth guards and orthodontic devices such as retainers are not included in the IRS definition of &amp;ldquo;taxable medical devices&amp;rdquo; for the purposes of the Medical Device Tax.&lt;/div&gt;

	Physical therapists (PTs) and physical therapist assistants (PTAs), especially those who have patients with wounds, are encouraged to take steps to protect their most vulnerable patients from carbapenem-resistant Enterobacteriaceae (CRE), a family of germs that have become difficult to treat because they have high levels of resistance to antibiotics. &lt;strong&gt;In addition to patients at high risks, PTs and PTAs should take all necessary precautions to prevent the spread of CRE to healthy individuals.&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	According to the Centers for Disease Control and Prevention (CDC), CRE are resistant to all, or nearly all, antibiotics&amp;mdash;even the most powerful drugs of last-resort. CRE also have high mortality rates, killing 1 in 2 patients who get bloodstream infections from them. Additionally, CRE easily transfer their antibiotic resistance to other bacteria. For example, carbapenem-resistant klebsiella can spread its drug-destroying properties to a normal E. coli bacteria, which makes the E.coli resistant to antibiotics also. &amp;quot;That could create a nightmare scenario since E. coli is the most common cause of urinary tract infections in healthy people,&amp;quot; says CDC.&lt;/p&gt;

		<title>Important Legislative Update</title>
		<description>&lt;p&gt;
	&lt;strong&gt;&lt;u&gt;After discovering a conflict between code and state law relating to a physical therapist&amp;rsquo;s ability to order x-rays, the WPTA obtained a legal opinion, which found that under state law and existing state rules and regulations, licensed physical therapists may not order x-rays.&lt;/u&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong&gt;Background&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	As stated in the physical therapy practice act in Wisconsin in statute 448.50 (4)(b): &amp;ldquo;Physical therapy does not include using roentgen rays or radium for any purpose, using electricity for surgical purposes, including cauterization, or prescribing drugs or devices.&lt;/p&gt;
&lt;p&gt;
	In 2005, the WPTA sought a legal opinion from the Department of Regulation and Licensing (DRL), known today as the Department of Safety and Professional Services (DSPS), regarding a physical therapist&amp;rsquo;s ability to refer a patient for x-ray. Specifically, the WPTA sought a legal response to the following statement: &amp;ldquo;It is the WPTA&amp;rsquo;s interpretation that the aforementioned article [448.50 (4)(b)] would not allow physical therapists to use (administer) roentgen rays or radium in provision of physical therapy, though would allow a physical therapist to request or refer patient&amp;nbsp; for these tests to be administered by the appropriate health care practitioner who is qualified to perform these tests.&amp;rdquo;&lt;/p&gt;
&lt;p&gt;
	An attorney from DRL, specifically the Physical Therapy Affiliated Credentialing Board (now the Physical Therapy Examining Board) Legal Counsel, responded favorably by responding: &amp;ldquo;Consistent with s. 448.50 (4) of the Wisconsin Statutes, the Board concurred with your conclusion that physical therapists may not administer roentgen rays or radium for any purpose. In addition the Board determined that a physical therapist may refer a patient for diagnostic imaging to an appropriate health care practitioner qualified to perform those tests. The results of those tests must then be interpreted by a qualified health care professional and may be utilized by a physical therapist to determine an appropriate course of physical therapy or to determine whether a referral to another health care provider is necessary.&amp;rdquo;&lt;/p&gt;
&lt;p&gt;
	Based on this response, the WPTA believed that licensed physical therapists in Wisconsin were allowed to refer a patient for x-ray. In the past month, the WPTA became aware of conflicting code within the Department of Health Services (DHS) that describes which licensed providers in Wisconsin may order an x-ray. As a result the WPTA requested the code citations and became aware of the following in DHS 157:&lt;/p&gt;
&lt;ul&gt;
	&lt;li&gt;
		DHS 157.03(155) &amp;ldquo;&amp;rsquo;Healing arts&amp;rsquo; means a profession concerned with diagnosis and treatment of human maladies, including the practice of medicine, dentistry, osteopathy chiropractic and podiatry.&amp;rdquo;&lt;/li&gt;
	&lt;li&gt;
		DHS 157.03(191) &amp;ldquo;&amp;lsquo;Licensed practitioner&amp;rsquo; means a chiropractor, dentist, physician, podiatrist, physician assistant, nurse practitioner or radiologist&amp;rsquo;s assistant licensed in the state of Wisconsin.&amp;rdquo;&lt;/li&gt;
	&lt;li&gt;
		DHS 157.74(2)(f): &amp;ldquo;Persons may not be exposed to the useful beam except for healing arts purposes and unless such exposure has been authorized by a licensed practitioner of the healing arts. Deliberate exposure for any of the following purposes is prohibited: DHS 157.74(1). . . All images, hard copy or electronic, shall be interpreted by a licensed practitioner for the patient record.&amp;rdquo;&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;
	After becoming aware of the code citations listed above, the WPTA Board of Directors authorized the WPTA President to seek a legal opinion on whether or not a licensed physical therapist in Wisconsin may order x-rays under state law and state rules and regulations.&lt;/p&gt;
&lt;p&gt;
	In addition to the code citations above, the legal analysis found that Wisconsin state statute 462.04 states &amp;ldquo;A person who holds a license or limited x-ray machine operator permit under this chapter may not use diagnostic x-ray equipment on humans for diagnostic purposes unless authorized to do so by prescription or order of a physician licensed under s. 448.04 (1) (a), a dentist licensed under s. 447.04 (1), a podiatrist licensed under s. 448.63, a chiropractor licensed under s. 446.02, an advanced practice nurse certified under s. 441.16 (2), or a physician assistant licensed under s. 448.04 (1) (f).&amp;rdquo;&lt;/p&gt;
&lt;p&gt;
	This statute became law in 2009; unfortunately the WPTA was not aware of the drafting, consideration, or enactment of this legislation because the WPTA would have lobbied aggressively to have physical therapists included in the legislation. And in the event physical therapists had not been included in the law, the WPTA would have notified its members of the new law and its impact on physical therapist practice, especially in light of the legal opinion we received from DRL in 2005.&lt;/p&gt;
&lt;p&gt;
	The WPTA believes that physical therapists should have the ability to refer patients and write orders for x-rays. Based on the education and training of physical therapists and in light of the role that physical therapists have as front line providers under direct access, data and evidence support that physical therapists are qualified to use x-rays as part of developing an overall physical therapy diagnosis and plan of care. Additional evidence supports that physical therapists order x-rays appropriately.&lt;/p&gt;
&lt;p&gt;
	The Wisconsin delegation played an active role in last year&amp;rsquo;s APTA House of Delegates that included the introduction of an amendment that led to the following statement as part of the Association&amp;rsquo;s position statement on Diagnosis by Physical Therapists: &amp;ldquo;When indicated, physical therapists order appropriate tests, including but not limited to imaging and other studies, that are performed and interpreted by other health professionals. Physical therapists may also perform or interpret selected imaging or other studies.&amp;rdquo;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;
	&amp;nbsp;&lt;/p&gt;
&lt;p&gt;
	&lt;strong&gt;Next Steps&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	The WPTA is working on developing an action plan to consider legislative options to get physical therapists added to the list of licensed providers that may order x-rays in Wisconsin.&lt;/p&gt;
&lt;p&gt;
	It is important to remember that the WPTA does not offer legal advice so specific legal questions should be directed to your own legal counsel. That being said, the purpose of this message is to inform members of updated legal information that the WPTA received regarding the legal authority for a licensed physical therapist to order x-rays in Wisconsin. We strongly believe that members have a right to know this information, which is why we are sharing it with you.&lt;/p&gt;
